Buchanan relies on the conception of political legitimacy to advance a justice-based, rather than consent-based, account of system legitimacy. He argues that despite the dominant view among international lawyers, the consent of states cannot confer legitimacy on the international legal system. Finally, Buchanan agrees that the international legal system should be democratic, but the way to go about that is not to rely on state majoritarianism.
